REAL ESTATE AND BANKRUPTCY
Capell & Howard's real estate practice involves both commercial and residential real properties. A majority of the Firm's engagement is in connection with the sale or development of commercial properties, such as shopping centers, apartment buildings, office buildings, condominiums, warehouses, and undeveloped land. The Firm serves as counsel to many developers of commercial properties throughout the Southeast and has expertise in a broad range of commercial transactions, including the structuring of ownership entities, zoning matters, title examinations and certification, lease and loan document negotiations and syndications. The Firm's residential real estate experience includes the development and financing of subdivisions and all aspects of residential sales and loan transactions.
The Firm also represents parties involved in mortgage and secured lending. Often, the primary, if not exclusive, collateral is real estate. Based upon its experience in representing developers and lenders, as well as landlords and tenants, the Firm is aware of the requirements of all parties to such transactions and is capable of crafting creative solutions for those problems.
The Firm's bankruptcy and foreclosure practice is principally limited to representation of creditors. The majority of the Firm's bankruptcy services are performed in connection with loan transactions and with respect to commercial clients.
