CONSTRUCTION AND GOVERNMENT CONTRACTS

          The Firm’s construction law section counsels and assists clients in avoiding situations which lead to litigation by drafting and reviewing construction contracts, providing advice during the bid and construction phases, negotiating disputes and resolving conflicts. Nevertheless, the Firm’s members have developed extensive experience in litigating construction claims in federal and state courts and before arbitration panels and various federal boards of contract appeals. The firm represents numerous general contractors, subcontractors and suppliers, owners, architects and engineers. Members of the Firm have written books and published articles on the subjects of lien laws and construction law and claims. They have lectured extensively on various aspects of lien laws, public works laws, and construction law claims and disputes.

          The Firm’s government contracts practice includes representing contractors on federal government projects in bid protest disputes and claims for equitable adjustments and breach of contract before contracting officers, various federal boards of contract appeals, the General Accounting Office, and federal courts. The firm regularly represents clients in local and state public contract matters, including licensing matters, bid protests, competitive bid law matters, and claims, before state agencies such as the State Licensing Board for General Contractors, the Alabama Building Commission, the Alabama Highway Department and before trial and appellate courts. The firm was retained by the Associated General Contractors to draft and assist in the successful passage in 1997 of Alabama’s new public works laws, which consolidated and modernized the competitive bid laws, the surety bond laws, and laws relating to remedies for the violation of the public works laws.

          In connection with its construction law services, the Firm regularly handles claims involving surety bonds. Members of the construction law section have extensive experience in bringing claims and defending claims brought under the Federal Miller Act, under Alabama’s Little Miller Act, and upon performance and payment bonds provided in the private sector.
